(1.1) Acceptance
All users of Perception9 Paranormal or other titles which may be used from time to time, hereinafter called the Website, are subject to the following Terms and Conditions and any other Terms and Conditions contained in or appearing on any section of this Website. The Webmaster reserves the right to amend any Terms and Conditions. If changes are made, attention will be drawn to this on the Website News Page. Use of this Website will then be subject to the changed Terms and Conditions. The Webmaster reserves the right of sole discretion to deny access to this Website or any part of this Website without notice to anyone, group or organisation failing to comply with any provision of the Terms and Conditions. (See also (3.8))

(1.2) Use of site
The Website may only be used for lawful purposes and in a manner that does not infringe the rights or restricts or inhibits the use and enjoyment of the site by any third party.

(1.3) Liabilities
In no event will the Website, the Webmaster, or anyone connected with the operation of this Website, or anyone giving any help, advice or tuition on or through this Website or by any other means related to Perception9 Paranormal (directly or as a result of introducing a third party), be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use or in connection with such use or loss of use of the website, or be liable for any loss, injury (both physical or mental) or death, whether in contract or in negligence. Users of any aspect of this Website do so at their own risk.

(1.4) Website Usage Guarantees
Neither this Website, its server, the Webmaster or anyone connected with the operation of this Website can guarantee:
That this Website has no errors or has total functionality.
That access will not be interrupted.

While every effort will be made and precautions taken to prevent infection, no guarantees can be given that this Website or its server are free of infection. It is the responsibility of the user to take precautions to protect their equipment, networks and systems from infection and to make every effort to ensure that no infection is passed to this Website or its server.(See (3.7))

Excluding any Contributor content shown under sections (4.5) and (6.3), the copyright contained in, on or which is available through this Website, in whatever form is owned or licensed by the Webmaster unless indicated to be otherwise. All rights are reserved.

(1.7) Privacy
No personal information submitted to this Website will be divulged to to third parties unless permission is given. The UK Data Protection Act will be strictly adhered to. (See also (4.13))

(1.8) Law
These Terms and Conditions shall be governed and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

(2) Registered Website Membership

(2.1) Eligibility for Registered Membership
Registered Membership is offered to all individuals and bona fida voluntary groups having paranormal interests ( - see (2.1.a) for Members under 13 years of age).

(2.1.a) Under 13 Year Old Users
There are interactive elements on the Perception9 Paranormal Website and as Members under 13 year old are able to use them it is the responsibility of a parent or legal guardian to monitor the minor in their usage of this Website.

(2.2) Registered Membership and Membership Categories
Currently, Registered Membership is offered free of charge and covers the full use of the Perception9 Paranormal Website. Any changes in this offer will be notified to users and Members on the News Page.
Members taking positions within the Website operational structure will become Honorary Life Members.
The Membership, through the Forum, can decide to create Honorary Life Memberships for other services as well as create other recognition ranks and the form that these should take.
Other categories of Membership will be set up as the Website progresses and Members will be notified of these on the News Page.
Special Interest Membership Groups can be set up by Members by contacting the Webmaster for approval in the first instance.

(2.3) Membership Benefits
Registered Members can submit work, articles and other media for inclusion on this site by contacting the Webmaster for approval in the first instance. Registered Members can post on and use the facilities of the Forum, have access to and post on the various other opportunities to review and comment, submit News and Event items and use other sections of this Website that are or will be for such Registered Membership exclusive use.

(2.4) Non Commercial Links
Mutual Links (free of charge) will be made, on request, to non commercial sites such as the website of a Member, group sites and other sites of interest. (See section (7))

(3) Contributors - General (Including Forum)

(3.1) Eligibility
Only Registered Members may post or submit any item to the Website.

(3.1.a) If a Registered Member, being under the age of 18 years, requires help, guidance or advice with any paranormal/supernatural related aspect, on any interactive part of Perception9 Paranormal, including the forum areas, consent that this may be undertaken must be given by a parent or guardian.

(3.2) Content Liability
Neither the Webmaster nor anyone connected with the running of this Website can guarantee the accuracy of any contributed item on the Website.

(3.3) Views Expressed
Any views expressed on the Website are those of the Contributors and not necessarily those of the Webmaster or anyone connected with the operation of the Website.

(3.4) Publicly Offensive Material
Neither the Webmaster nor anyone connected to the operation of this Website can control or prevent the posting such material and consequently is in no way responsible for it. Every effort will be made to rid the website of any publicly offending material and Membership will be withdrawn from anyone creating and posting offending material. Should that member have any contribution on the website, that work will be removed at the discretion of the Webmaster. (Other reasons for work removal) (4.9).

(3.5) Material Offending Website Users
In addition to (3.4), if anything from a Member is deemed offensive to the Webmaster or anyone connected with the operationg of the website or Contributor or other Member, the offended party will have the right to advise the Webmaster on what action they would wish to be taken. The Webmaster reserves the right to decide on action taken but in the case of extremely offensive material, (3.4) will operate.

(3.6) Member Conduct
In parallel with (3.4) and (3.5), no Member may post or otherwise submit any item violating the rights, which includes, without limitation, intellectual property rights, of third parties. Or post or otherwise submit any item which is unlawful, damages, threatens, abuses, offends, defames, flames or harasses third parties. Or post or otherwise submit any item which is purely argumentative, hateful, offensive (sexually, racially religiously etc.), or which invades the privacy of any third party. See Contributor's Work (4.4).

(3.7) Viruses Etc
Further to (1.5), no post or item submitted is to contain any form of Spamming, Virus, Bug, Trojan or any form of Malware. Any person, group or organisation found deliberately doing this will be reported to all relevant authorities.

(3.8) Denial of Access
In accordance with (1.1), the Webmaster reserves the right of sole discretion to deny access to this Website or any part of this Website without notice to any person, group or organisation failing to comply with sections (3.6) and (3.7).

(3.9) Comments on Submitted Items
Any comments or views made on items marked as not for comment or review will be removed. Should any item marked that it can be reviewed or commented upon (see (4.12)) attract a negative comment, please note; it is the item itself to be commented on, not the contributor.

(4) Contributors - Items

(4.1) Website Publication of Items
All items accepted will be published in accordance with the layout of the Website.

(4.2) Submission of Items
All work must be submitted to the Webmaster by email or Personal Messaging unless other arrangements have been made.

(4.3) Acceptance and Rejection
The Webmaster reserves the right to accept or reject any item submitted. Rejection will NOT be made based on the preferences or beliefs of the Webmaster or those of anyone else connected with the operation of this Website.

(4.4) Where Rejection Will be Made
Further to (3.6), rejection will definitely be made on the grounds of pornography, bad taste, bigotry, racism or related grounds. Due to the open nature of the Internet and the Website, with children and other vulnerable groups having access, Contributors must bear in mind that explicitly violent or sexual material cannot be accepted. If a contributor is unsure about submitting an item which may border on or fall under this category, please submit it to the Webmaster for appraisal. The best guide to this is whether such an item could be publicly viewed elsewhere.

(4.5) Copyright and Ownership
Further to (1.6) total control of an item remains with the Contributor or Copyright Holder unless an agreement is made otherwise. No copyright is transferred to the Website or to the Webmaster through the act of publishing items on this Website. If requested, a copyright mark (©) will be displayed on items, together with the Copyright Holder's name and year.

(4.6) Agreement of Copyright Holder to Publish on this Site
Nothing will be published on this Website without the agreement of the Copyright Holder, who will be taken to be the Contributor unless the Webmaster or anyone connected with the running of the Website is advised otherwise. All items published on this Website are accepted in good faith. Neither this Website, the Webmaster nor anyone connected with the operation of this Website accepts any responsibility for the publication of an item when the Contributor is not the Copyright Holder. The sole responsibility rests with the Contributor.

(4.7) Use of Copyright
Please bear in mind that there are certain exceptions to the rights given to the Copyright Holder. For example, limited use of works may be possible for non-commercial research and private study, criticism or review, reporting current events, judicial proceedings and teaching in schools.

(4.8) Removal of Items from the site by the Contributor
Should the Contributor request the removal of an item from this site, it will be done at the earliest opportunity.

(4.9) Removal of Items from the site by the Webmaster
With the exceptions of sections (3.4), (3.5) and (4.10), if the Webmaster requires that an item be removed, it will not be done until the Contributor is informed of the reason for removal or reasonable efforts have been made to contact the Contributor. If contacted, the Contributor has three days to contest removal but any final decision is to be made by the Webmaster. If no contact with the Contributor can be made within seven days, the work will be removed. If the Server to this Website or any other authority requires removal of any item, their demands will be actioned immediately. Should this occur, the Webmaster will contact and inform the Contributor of the reasons or make reasonable efforts to do so.

(4.10) Work Removed from the site due to Lost Contact with Contributor
If a Contributor has not used the Website in any way for a period of a year, their work may be removed from this Website without notice.

(4.11) Out of Date Items
These will be removed without reference to the Contributor. Out of date items are those where calender dates have expired.

(4.12) Comments and Reviews of Contributions
On contributing an item, the Contributor will be given the option to have that item marked as being open for comment or review. For acceptable comments (see (3.9)).

(4.13) Contributor Privacy
In parallel with section (1.7), Contributors have the option to attach their own name or their Website User Name to an item. Should anyone viewing the Website wish direct contact with that Contributor, the Contributor will be informed by the Webmaster. If the Contributor wishes, the Webmaster will, in the first instance, act as 'go between'.

(5) News and Events Pages

(5.1) Usage
Available for use by Registered Members.

(5.2) News and Events Pages
For non commercial use of Members to publish items of interest to the Website community. If contact is required from interested Website Users it will be directly with the party placing the notice and not through this Website. If the item is for a commercial purpose please refer to section (6). If a Contributor is unsure whether the item is commercial or not, please discuss with the Webmaster. An example being that if an event is organised to make a profit on behalf of a charity, it is not deemed commercial.

(6.1) Commercial Users
Defined as persons or organisations who wish to use the Website to sell goods or services and/or to advertise. Individuals within this group are able to become Registered Members but membership will be removed if unfair commercial advantage is taken of this.

(6.2) Costs and Charges for Commercial Use of the Website
Please contact the Webmaster to discuss this. All Commercial matters will be treated in the strictest confidence.

(6.3) Trade Marks, Copyright and Patents
Further to (1.6) all Trade Marks, Copyrights and Patent material submitted by any Commercial User remain totally in the control of the submitting body or the Trade Mark Owner, Copyright Holder or the Patent Holder.
